1. Acceptance of Terms

By downloading, installing, or using FitCheck ("the App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and FitCheck. They apply to all users of the Service, including free and paid subscribers.

2. Description of Service

FitCheck is an AI-powered wardrobe management and styling application that provides:

• Wardrobe management: Photograph, catalog, and organize your clothing items
• AI Stylist: Personalized outfit suggestions based on your wardrobe, weather, occasion, and mood
• Outfit planning: Schedule outfits for upcoming days and events
• Sustainability tracking: Measure re-wear frequency, cost-per-wear, and environmental impact
• Community features: Share outfits, follow other users, and discover style inspiration
• Analytics: Insights about your wardrobe composition, wearing patterns, and style evolution

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Account Registration

• You must be at least 13 years old to create an account and use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content & License

Your Content

You retain ownership of all content you upload to FitCheck, including photos, wardrobe data, outfit combinations, and social posts ("User Content").

By uploading User Content, you grant FitCheck a limited, non-exclusive, worldwide, royalty-free license to:

• Store and process your content to provide the Service
• Display your content within your account and on devices you authorize
• Process your content through our AI to generate styling suggestions
• Show your public posts to other users as part of community features

Your Responsibility

You represent and warrant that:

• You own or have the right to upload any content you share
• Your content does not violate any third party's intellectual property rights
• Your content complies with applicable laws and our Community Guidelines

5. AI Stylist Features

• Suggestions, not directives: AI-generated outfit suggestions are recommendations only. FitCheck is not liable for any fashion choices you make based on these suggestions.
• Accuracy: While we strive for quality suggestions, AI results may not always match your preferences or be factually accurate. Weather data may occasionally be delayed or imprecise.
• Availability: AI generation features may have daily limits for free accounts. Supporter accounts receive expanded or unlimited access as described in the app.
• Feedback: By providing feedback on AI suggestions (liking, saving, or dismissing), you help improve the service. This feedback is used in aggregated, anonymized form only.

6. Subscription & Payments

Free Tier

FitCheck offers a free tier with core features including wardrobe management, limited AI generations, and community access.

Supporter Plan

• The Supporter Plan unlocks unlimited AI generations, advanced analytics, priority support, and other premium features.
• Pricing is displayed in the app and may vary by region. Prices are subject to change with notice.
• Subscriptions are billed through your App Store or Google Play account on a monthly or annual basis.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• No partial refunds are provided for unused portions of a billing period.

7. Community Guidelines

When using FitCheck's community features, you agree to:

• Be respectful and kind to other community members
• Share authentic outfit photos and genuine style inspiration
• Not post misleading, deceptive, or irrelevant content
• Not share someone else's photo without their permission
• Not post content that promotes fast fashion overuse, waste, or unsustainable practices in a harmful way
• Tag content appropriately and respect content warnings
• Report content that violates these guidelines

FitCheck reserves the right to remove content and suspend accounts that violate these guidelines.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Upload content that is obscene, hateful, threatening, or harassing
• Attempt to gain unauthorized access to other users' accounts or our systems
• Use automated scripts or bots to access the Service
• Reverse engineer, decompile, or disassemble the application
• Interfere with or disrupt the Service or servers
• Create multiple accounts for fraudulent purposes
• Share your account credentials with others
• Use the Service to stalk, harass, or bully others

9. Intellectual Property

The FitCheck application, including its design, logo, icons, and underlying technology, is owned by FitCheck and protected by intellectual property laws. Our trademarks and trade dress may not be used without written permission.

You may not:

• Copy, modify, or distribute any part of the Service without our written consent
• Use our branding, logos, or trademarks without authorization
• Create derivative works based on the Service
• Frame or mirror any part of the Service

10. Termination

• By you: You may delete your account at any time through the app settings. Account deletion is permanent and irreversible.
• By us: We may suspend or terminate your account if you violate these Terms, with or without prior notice.
• Upon termination: Your right to use the Service ceases immediately. We will delete your data within 30 days of account termination, subject to legal retention requirements.
• Survival: Sections 4, 8, 9, 11, 12, and 14 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, completeness, or reliability of AI-generated suggestions
• Warranties regarding weather data, sustainability calculations, or analytics

You use the Service and any AI-generated suggestions at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITCHECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the Service
• AI-generated outfit suggestions
• Any errors or inaccuracies in weather data or sustainability analytics
• Any unauthorized access to or alteration of your data
• Any conduct of users of the community features

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Post the updated Terms on this page with a revised "Effective" date
• Notify you via in-app notification or email
• For significant changes, provide at least 30 days' notice before the changes take effect

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Chiang Mai, Thailand.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
